Judge to be questioned in wrongful conviction case

— An appeals court says a former prosecutor who is now a Texas judge can be questioned by attorneys for a man who is claiming he was wrongfully sent to prison for nearly 25 years because evidence was suppressed in his case.

Attorneys for state District Judge Ken Anderson wanted the Texas Court of Criminal Appeals to stop his deposition by lawyers for Michael Morton.

Morton was freed this month based on new DNA evidence after serving 24 years of a life sentence in the 1986 murder of his wife in Williamson County, located near Austin.

The appeals court Wednesday denied Anderson’s attempts to stop his deposition.

Anderson is to be questioned on Monday in Williamson County.

Anderson’s deposition is part of efforts investigating accusations he concealed evidence at Morton’s trial.
