Port Arthur man indicted on 4th DWI charge

A 36-year-old Port Arthur man with three previous convictions for driving while intoxicated reportedly rocked back and forth and had problems performing simple sobriety checks during a July traffic stop was indicted for a subsequent DWI charge recently.

According to court documents, Johnny Ray Davis Jr. had prior convictions in February 2013, September 2018 and October 2022.

On July 3, a Port Arthur Police Department officer on routine patrol on 32nd Street reportedly saw a vehicle traveling approximately 50 mph in a 30 mph zone. The office stopped the vehicle, which came to rest at 31st Street and U.S. 69, according to the probable cause affidavit.

The officer allegedly saw an open container in the center console. After the driver stepped outside the vehicle the officer noted signs of intoxication during the Horizontal Gaze Nystagmus.

The driver was reportedly confused and unsteady on his feet during the HGN and rocked from side to side.

He reportedly performed poorly during the finger count and during backwards counting as well as the Walk and Turn and during the One Leg Stand, the document read.

Davis gave two breath samples with the results at 0.062 and 0.067.

Davis was transported to the county jail without incident and charged with DWI 3rd or more.
