Court date set for PA council election contestation

A court date has been set three months later in Tiffany Hamilton, District 2 councilwoman’s contest of the May 2017 General Election results for the city council of Port Arthur.
Hamilton wrote in an email the court date is set at 10 a.m. for Monday, Aug. 14 in the 60th District Court at the Jefferson County Courthouse, 1149 Pearl St. in Beaumont. Judge John Wooldridge will hear the case as a visiting judge.
“He will judge on the argument that persons who were eligible to vote in District 2 were denied the right to vote in District 2,” Hamilton wrote. “Their denial had a direct reflection on the election results.”
According to the Texas Election Code the plaintiff, Hamilton, is the candidate acknowledging discrepancies within the election process. In addition, the code recognizes the alleged winner of the election at issue as the defendant, Carroll (Cal) Jones. Both parties have retained independent council.
Jones was declared the winner of the May election.
“There are no claims that the defendant, Carroll Jones, is at fault for the discrepancies of the election at issue,” she wrote. “The facts prove that the current results of the election are false. In the alternative, if the evidence shows that the true outcome of the election cannot be determined by these allegations, then the court must call a new election as provided by the Texas Election Code to determine the winner of the election.”
Wooldridge may or may not make final judgment on August 14th.
Jones declined to make any comment at this time.
